Phoenix and Tucson Try to Skirt Election Law

Like most states across the country, Arizona has long suffered from abysmally low voter turnout in local elections. In the state’s two largest cities – Phoenix and Tucson – voter turnout rates for the most recent local candidate elections hovered at a mere 30 percent.

Last year, Arizonans overwhelmingly passed a constitutional amendment that told workers “if your company is deciding whether or not to unionize, you have a constitutional right to cast your vote in secret.” But now, the NLRB is trying to strike down the amendment through a federal lawsuit. If they succeed, a union sympathizer would be permitted to accost a fellow employee and watch as the employee votes on whether or not to unionize.

Do Police Officers Pay for Release Time?

The Goldwater Institute recently filed a lawsuit challenging Phoenix’s “release time” practice that sends six city police officers to work as full-time union managers, 35 to work as part-time union representatives, and one to work as a union lobbyist. Although these employees are released from city duties to perform union duties, taxpayers continue to pay the officers’ salaries and benefits.

In December, the Goldwater Institute filed a constitutional challenge to the City of Phoenix’s practice of “release time” within the police union. This practice takes six city police officers off the streets and puts them behind desks to work as full-time union managers, 35 to work as part-time union representatives, and one to work full time as a union lobbyist – all while collecting city salaries and benefits.

Right-to-work laws prohibit workers from being forced to join a union, pay union dues, or pay union representation fees. For unions, right-to-work laws mean they have to actually fight to retain customers – no more guaranteed income.
