Imagine the government helped someone forge your signature to access your paycheck. It’s reality: public-sector labor unions forge people’s signatures on membership cards, government employers let it happen, and those agencies just keep deducting money from people’s checks and handing it over to the unions.
It needs to stop. That’s why the Goldwater Institute recently filed a brief urging the U.S. Supreme Court to end the public-sector union forgery schemes.
Under the First Amendment, no one can be forced to be a union member, remain a union member, or pay union dues. But the government is dodging accountability, claiming only the unions committed the fraud to stop employees from leaving. In other words, government employers facilitated a fraud—and are now literally passing the buck…to the forgers.
But as our brief explains, government has a constitutional duty to prevent participation in illegal activity, and Goldwater attorneys are working nationwide to hold government accountable for failing to fulfill this important duty. As for the unconstitutional forgery schemes that have only enriched the powerful at the workers’ expense, it’s past time for them to end.

Arizona’s impressive ranking comes as more than 70,000 students have taken advantage of the state’s universal Empowerment Scholarship Account (ESA) program—the most expansive program of its kind in America. Universal ESAs, which the Goldwater Institute enacted last year as the gold standard for school choice after pioneering the nation’s first ESA program in Arizona more than a decade ago, offer school choice to any family that wants it.
